HYROX Simulation Participant Waiver

The HYROX Simulation at University of Stirling Sport (referred to as ‘this/the event’ hereinafter) is a fitness event that involves a range of movements and requires a certain level of fitness and preparation to undertake so it is important you understand and acknowledge the following (you hereinafter also referred to as "I"):

1. Risks

1.1 I understand this event will be strenuous and will push me to the limits of my physical abilities.

1.2 I understand and accept there are varying levels of risk of participating in such events which can lead to loss, serious injury or death. 

1.3 I accept there is risk of loss, serious injury or death due to a variety of factors including, but not limited to; injury to the musculoskeletal and/or cardiorespiratory systems, negligence on the part of myself, my partner, teammates or others, improper use or failure of equipment due to my own negligence, or due to a medical condition (known or unknown to myself).

1.4 I willingly enter this event entirely at my own risk and am fully aware of the risks of participation.

1.5 I assume all responsibility for my participation and that the event organiser will not be liable for any injury before, during or after the event caused by my own negligence or non-compliance with instruction or event rules.

2. Readiness to exercise

2.1 I declare I am physically fit and certify I know of no medical conditions that would increase my risk of illness and injury as a result of participating in this fitness event.

2.2 I have read University of Stirling Sport’s readiness to exercise and health commitment statement and certify I comply and will comply with all conditions outlined.

3. Indemnification

3.1 I understand and accept the risks of participating in this event and waive and renounce any rights/claims for damages that I may have against the organisers and sponsors for any loss, serious injury or death as a result of my own negligence or non-compliance with instruction or event rules.

3.2 I accept financial responsibility for any injury that I may cause to myself or other participants due to my negligence and should University of Stirling Sport, or anyone acting on its behalf, incur legal fees to enforce this agreement, I agree to reimburse them for such costs.

3.3 I agree to indemnify and hold harmless any organisers of this event from liability of the injury or death of any person(s) and damage to property that may result from my negligent or intentional act whilst participating in the event.

4. Participation

4.1 I understand that, for safety reasons, that my space should NOT be given to other participants who have not read and accepted this participant waiver and I am responsible for communicating any change of person(s) participating to the organisers with sufficient notice for replacement participants to accept the participation waiver and declaration.

4.2 I accept my entry fee is strictly non-refundable.

4.3 I consent to the provision of first aid and other medical treatment in the event of injury or illness (including but not limited to cardiopulmonary resuscitation and use of an automated external defibrillator) and hereby exonerate the organizer and release them from any liability or claims arising from such treatments. I am aware that I can withdraw from the event at any time for my own protection and the protection of
others.

4.4 Pictures, sound recordings and videos: Pictures, sound recordings and videos that show me partially or completely during and in the context of the event may be used with my personal data, such as first name, last name, for documentation, information and advertising purposes without any time or space restrictions to be published in all media. I acknowledge that I have no entitlement to be named as an athlete or to be granted a financial advantage if the image and/or audio material is mentioned or depicted or reproduced.

Declaration

By electronically confirming this statement of declaration in the form of opting-in, you (hereinafter also referred to as "I") hereby declare the following:

I have fully read and understand the aforementioned details of risk, readiness to exercise assumptions, release of liability and participation consents and understand that by acknowledging and accepting these terms (via electronically opting-in) I am waiving valuable legal rights.
